This document sets out the privacy policy ("Privacy Policy") of Falkor Vision Ltd, which is an Israeli corporate entity (referred to herein as “Falkor”, “we”, “us” or “our”). This Privacy Policy is incorporated as part of our Terms of Use (the “Terms of Use”). Capitalized terms used and not specifically defined herein, shall have the meaning ascribed to them in the Terms of Use. Your use of the Falkor Solution (including, for the avoidance of doubt, our website, indicates your consent to this Privacy Policy and to the Terms of Use.
Falkor respects your privacy and is committed to protecting your personal data.
We take your privacy very seriously and therefore we will not collect any unnecessary personal data from you and will process your data in accordance with the terms specified in this Privacy Policy. We will not share or disclose any of your personal data without your consent, other than for the purposes specified in this Privacy Policy, and were required to do so by law. We will only retain your personal data for as long as is necessary and for the purposes specified in this Privacy Policy, and thereafter we will ensure its complete erasure or destruction.
We work hard to protect you and your personal data from unauthorized access, alteration, disclosure, or destruction.

This Privacy Policy covers the information we collect about you when you use our products or services, or otherwise interact with us (for example, by interacting with us in our website or by communicating with customer support or marketing departments). We refer to the Falkor Solution (which include all of our products, together with our other services and websites) as "Services" in this Privacy Policy.
This Privacy Policy also explains your choices regarding how we use personal data, which include how you can object to certain uses of information about you and how you can access and update certain information about you.
Data Controller/Processor
Certain data protection laws and regulations, such as the European Union General Data Protection Regulation (the “GDPR”) or the California Consumer Privacy Act (“CCPA”), typically distinguish between two main roles for parties processing personal data: the “data controller” (or under the CCPA, “business”), who determines the purposes and means of processing; and the “data processor” (or under the CCPA, “Services provider”), who processes such data on behalf of the data controller (or business). Below we explain how these roles apply to our Services, to the extent that such laws and regulations apply.
Falkor is the “data controller” of its Prospects’ (as defined below), users’ and customers’ personal data, as detailed:
- User Data: personal data concerning our Customers’ internal focal persons who directly engage with our products concerning their account, customer’s account admins, and authorized users of the Services.
- Prospect Data: data relating to visitors of our websites, participants at our events, and any other prospective customer, user or partner (collectively, “Prospects”) who visits or otherwise interacts with our websites, digital ads and content, emails, integrations or communications under our control.
Falkor LTD is the “data processor” of personal data contained in customer data, as submitted by our customers and their users to their account’s in our Services. We process such data on behalf of our customer (who is the “data controller” of such data) and in accordance with its reasonable instructions, subject to our Terms of Use, our Data Processing Addendum (to the extent applicable) and other commercial agreements with such customer.
Our customers are solely responsible for determining whether and how they wish to use our Services, and for ensuring that all individuals using the Services on the customer’s behalf or at their request, as well as all individuals whose personal data may be included in customer data processed through the Services, have been provided with adequate notice and given informed consent to the processing of their personal data, where such consent is necessary or advised, and that all legal requirements applicable to the collection, use or other processing of data through our Services are fully met by the customer. Our customers are also responsible for handling data subject rights requests under applicable law, by their users and other individuals whose data they process through the Services.
What information we collect about you
We collect information about you when you provide it to us, when you use our Services, and when other sources provide it to us, as further described below.
Information you provide to us
We collect information about you when you input it into the Services or otherwise provide it directly to us.
Account and Profile Information: We collect information about you when you register for an account, create or modify your profile, set preferences, sign-up for the Services. For example, you provide your contact information when you register for the Services.
We collect content using analytics techniques that hash, filter or otherwise scrub the information to exclude information that might identify you or your organization; and we collect clickstream data about how you interact with and use features in the Services.
Content you provide through our websites: The Services also include our websites. We collect other content that you submit to these websites, which include social media or social networking websites operated by us. For example, you provide content to us when you provide feedback or when you use our contact us form.
Information you provide through our support channels: The Services also include our customer support, where you may choose to submit information regarding a problem you are experiencing with a Service. Whether you designate yourself as a technical contact, open a support request, speak to one of our representatives directly, or otherwise engage with our support team, you will be asked to provide contact information, a summary of the problem you are experiencing, and any other documentation, screenshots or information that would be helpful in resolving the issue.

To communicate with you about the Services: We use your contact information to send transactional communications via email and within the Services, including, reminding you of subscription expirations, responding to your comments, questions and requests, providing customer support, and sending you technical notices, updates, security alerts, and administrative messages. The lawful basis for using and processing this data is legitimate interest.
Customer support: We use your information to resolve technical issues you encounter, to respond to your requests for assistance, to analyze crash information, and to repair and improve the Services. We may share information with a third-party expert for the purpose of responding to support-related requests. The lawful basis for using and processing this data is performance of a contract.
For safety and security: We use information about you and your Service use to verify accounts and activity, to detect, prevent, and respond to potential or actual security incidents and to monitor and protect against other malicious, deceptive, fraudulent, or illegal activity, including violations of Service policies The lawful basis for using and processing this data is legitimate interest.
To protect our legitimate business interests and legal rights: Where required by law or where we believe it is necessary to protect our legal rights, interests, and the interests of others, we use information about you in connection with legal claims, compliance, regulatory, and audit functions, and disclosures in connection with the acquisition, merger or sale of a business. The lawful basis for using and processing this data is legitimate interest.
If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any usage and/or processing that has already taken place.
No sale of personal data
Falkor does not and will not sell your personal data or other personal data you process in our Services.
How we share and disclose information we collect
We may share or disclose personal data in the following instances:
Service Providers: We engage selected third-party companies and individuals as service providers, to perform services on our behalf or complementary to our own. These include providers of services such as: hosting and server co-location services, data and cyber security services, investigation and prevention services, web and mobile analytics, email and communication distribution and monitoring services, session or activity recording services, call recording, analytics and transcription services, event production and hosting services, performance measurement, data optimization and marketing services, support and customer relation management systems, third-party customer support providers, and our legal, compliance and financial advisors and auditors.
Our service providers may have access to personal data, depending on each of their specific roles and purposes in facilitating and enhancing our Services or other activities, and may only use the data as determined in our agreements with them.
Customers and other Users: Your personal data may be shared with the Customer owning the account to which you are subscribed as an End User (including data and communications concerning your user profile), as well as other End Users of that account.
Services integrations: You or your account admin may choose to integrate your account on the Services with a third-party Services (provided that such integration is supported by our Services). The provider of this integrated third-party Services may receive certain relevant data about or from your account on the Services, or share certain relevant data from the account on the third-party provider’s services with our Services, depending on the nature and purpose of such integration.
Legal Compliance: In exceptional circumstances, we may disclose or allow government and law enforcement officials access to your personal data, in response to a subpoena, search warrant, or court order (or similar requirement), or in compliance with applicable laws and regulations. Such disclosure or access may occur if we believe in good faith that: (a) we are legally compelled to do so; (b) disclosure is appropriate in connection with efforts to investigate, prevent, or take action regarding actual or suspected illegal activity, fraud, or other wrongdoing; or (c) such disclosure is required to protect the security or integrity of our products and Services.
Falkor Subsidiaries: We share personal data internally within our group of companies, for the purposes described in this Privacy Policy. In addition, should Falkor or any of its subsidiaries undergo any change in control, including by means of merger, acquisition, or purchase of substantially all of its assets, your personal data may be shared with the parties involved in such an event. If we believe that such change in control might materially affect your personal data then stored with us, we will notify you of this event and the choices you may have via email or prominent notice on our Services.
For the avoidance of doubt, Falkor may share your personal data in additional manners, pursuant to your explicit approval, or if we are legally obligated to do so, or if we have successfully rendered such data non-personal and anonymous.
How we store and secure information we collect
All of your personal data remains private and confidential. The security of your personal data is important to us. When you enter sensitive information we encrypt the transmission of that information using secure socket layer technology (SSL).
Falkor maintains a comprehensive written information security program that complies with applicable law and generally accepted industry standards. Our program includes appropriate administrative, technical, and physical safeguards, procedures, and practices to protect personal data submitted to us or collected by us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, however, is 100% secure. Therefore, we cannot guarantee its absolute security. Falkor and its representatives will never request your account credentials. You should never share your account information, including your username and password, with anyone else. We recommend that you use a unique password for your account that is not associated with other websites. You should check your account regularly to ensure that your personal data has not been tampered with or altered. You should only use the Services within a secure environment.
Any suspicious activity regarding your account, including automated messages or calls from parties you cannot identify, should be reported to your site administrator and Falkor using the contact information below.
Data subject rights
Depending on your jurisdiction, data protection and privacy laws provide you with the ability to exercise certain rights regarding your personal data that we process, such as:
- The right to access the personal data we hold about you.
- The right to access and be informed about how your personal data is being used.
- The right to request the correction of inaccurate personal data we hold about you.
- he right to request that we delete your data or stop processing it or collecting it, in some circumstances.
- The right to request that we transfer or report elements of your data either to you or another service provider.
- The right to complain to a supervisory authority; and
- To the extent that the legal basis for our processing of your personal data is consent, you have the right to withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing before the withdrawal.
Where the Services are administered for you by an administrator from your organization, you may need to contact your administrator to assist with your requests first. For all other requests, you may contact us as provided in the “Contact Us” section below to request assistance.
Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep.
Opt out of communications: You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Service account settings menu, or by contacting us as provided below to have your contact information removed from our promotional email list or registration database. Even after you opt out from receiving promotional messages from us, you will continue to receive transactional messages from us regarding our Services.

Data location and cross border data transfers
We and our authorized service providers maintain, store and process personal data in the United States, Europe, Israel, and other locations as reasonably necessary for the proper performance and delivery of our Services, or as may be required by applicable law.
Falkor is headquartered in Israel, a jurisdiction which is considered by the European Commission, to be offering an adequate level of protection for personal data of individuals residing in EU Member States. We transfer data from the EEA to Israel on this basis.
While privacy laws vary between jurisdictions, Falkor, its affiliates, and its service providers are each committed to protect personal data in accordance with this Privacy Policy, customary and reasonable industry standards, and such appropriate lawful mechanisms and contractual terms requiring adequate data protection, regardless of any lesser legal requirements that may apply in the jurisdiction to which such data is transferred. For data transfers from the EEA, the UK, and Switzerland to countries that are not considered to be offering an adequate level of data protection, we and the relevant data exporters and importers have entered into “Standard Contractual Clauses” as approved by the European Commission.
Retention of personal data
We will retain your personal data for as long as it is reasonably necessary in order to establish, maintain and expand our relationship and provide you with our Services and offerings; in order to comply with our legal and contractual obligations; or to protect ourselves (and others) from any potential disputes (i.e., as required by laws applicable to log-keeping, records and bookkeeping, and in order to have proof and evidence concerning our relationship, should any legal issues arise following your discontinuance of use), all in accordance with our policies, and applicable laws.
Please note that except as required by applicable law or our specific agreements with you, we will not be obligated to retain your personal data for any particular period, and we are free to securely delete, anonymize or restrict access to it for any reason and at any time, with or without notice to you.

Cookies and Tracking Technologies
A cookie is a small file that asks permission to be placed on your computer’s hard drive. Once you agree, the file is added, and the cookie helps analyze web traffic. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes, and dislikes by gathering and remembering information about your preferences.
